Moped License

Many clients facing significant license sanctions will inquire about alternative transportation options.  This can be especially important in areas where public transportation is not widely available.  I have been asked on multiple occasions about the possibility of utilizing a Moped with a Moped License.  Unfortunately, for most individuals facing driver license sanctions, this is not going to be an option.

The Michigan Legislature does not require a special restricted moped license to operate a moped if an individual has a valid operator’s license. Further, an individual with a valid operator’s license cannot also be issued a special restricted moped license. One cannot have an unrestricted operator’s license and also maintain a specially restricted license which limits driving privileges to only a moped. Conversely, an individual’s specially restricted moped license would dissipate upon issuance of an unrestricted operator’s license.

Individuals without an unrestricted operator’s license who seek a special restricted moped license must first satisfy the discretion of the Secretary of State. The Secretary of State requires that you be 15 years of age or older, unlicensed, and able to operate a moped safely. While the Secretary of State has not officially promulgated any rules regarding safely operating a moped, unofficially, the Secretary of State states, “You are not eligible for a moped license if your operator or chauffeur license is suspended, revoked, or denied unless the suspension is for a medical reason.”

Because the special Moped License is only available to unlicensed individuals who are not facing a suspension or revocation it is not a viable alternative form of transportation and the unlicensed operation of a moped could result in further criminal and license sanctions.
